TERMS OF SALES

To pay for your stay:
If you live in France: you can pay your stay by credit card, holiday vouchers or transfer to the order of MESOMAX 2 - Luc DELESALLE.
If you live abroad: You can pay by international credit card or bank transfer or, if necessary, have a bank check drawn by your banker.
In any case, send your payment with your lease (deposit) or with your invoice (payment of the balance).

Article 1: The present contract is reserved for the exclusive use of the rental of Gîtes of MESOMAX 2
Article 2 - length of stay: The client signing this contract concluded for a specified period may under no circumstances claim any right to maintain the premises at the end of the stay.
Article 3 - liability: La Verdiere, which offers services to a client, is the sole interlocutor of this client and answers to him the performance of the obligations arising from these terms and conditions of sale.La Verdiere can not be held responsible for fortuitous events, cases of force majeure or the fact of any person foreign to the organization and the course of the stay.
Article 4 - reservation: The reservation becomes firm when MESOMAX 2 receives a deposit of 25% of the total price of the stay and a copy of the contract signed by the customer, before the deadline indicated on the front.
Article 5 - payment of the balance: The customer must pay the balance of the agreed service and remaining due one month before the start of the stay.
The customer who has not paid the balance on the agreed date, is considered to have canceled his stay. Therefore, the
benefit is offered for sale and no refund will be made.
Article 6 - late registrations: In case of registration less than 30 days before the start of the stay, the full payment will be required upon booking.
Article 7 - voucher: Upon receipt of accommodation costs, MESOMAX 2 sends the customer an acknowledgment of receipt.
Article 8 - arrivalThe client must appear on the specified day and at the times mentioned on this contract.
In case of late or late arrival or last minute stoppage, the customer must notify MESOMAX 2 whose address and phone are listed on the listing.
Article 9 - cancellation by the customer: All cancellations must be notified by mail and by registered letter or telegram to MESOMAX 2.
For any cancellation made by the client, the amount reimbursed to the latter will be as follows:
Cancellation more than 30 days before the beginning of the stay: it will be retained 25% of the amount of the stay.
Cancellation less than 30 days before the beginning of the stay: it will be retained 100% of the price of the stay.
In case of no-show, there will be no refund.
Article 10 - modification of a substantial element: When before the scheduled date of the beginning of the stay MESOMAX 2 is forced to make a modification to one of the essential elements of the contract, the buyer can, and after having been informed by registered letter with acknowledgment of receipt:
terminate his contract and obtain, without penalty, the immediate reimbursement of the amounts paid
or accept the modification or substitution of proposed places of residence. An amendment to the contract specifying the modifications made is then signed by the parties.
Any reduction in price is deducted from any sums remaining due by the buyer and if the payment already made by the latter exceeds the price of the modified service, the overpayment will be refunded to the tenant before the start of his stay.
Article 11 - cancellation by the seller: When before the beginning of the stay, MESOMAX 2 cancels this stay, he must inform the buyer by registered letter with acknowledgment of receipt.
The buyer will be refunded immediately and without penalties of the sums paid. He will also receive compensation at least equal to the penalty he would have incurred if the cancellation had been made by him on that date.
These provisions do not apply when an amicable agreement is concluded for the acceptance by the buyer of a substitute stay proposed by the seller.
Article 12 - impediment for the seller to provide during the stay the benefits provided for in the contract:
When during the stay, MESOMAX 2 is unable to provide a preponderant share of the services provided for in the contract, representing a significant percentage of the price paid by the buyer, La Verdiere will offer a stay to replace the stay planned in possibly supporting any additional price. If the stay accepted by the buyer is of lower quality, MESOMAX 2 will refund the price difference before the end of his stay. If MESOMAX 2 can not offer him a substitute stay or if it is refused by the buyer for valid reasons, the first will pay the second compensation calculated on the same basis in case of cancellation by the seller .
Article 13 - interruption of stay: In the event of interruption of the stay by the client, there will be no
refund.
Article 14 - Capacity: This contract is established for a maximum capacity of 8 people.If the number of holidaymakers exceeds the capacity, MESOMAX 2 may refuse additional guests. Any modification or breach of the contract will be considered at the initiative of the customer.
Article 15 - animals: This contract specifies that the customer can not stay with a pet.
In case of non-compliance with this clause by the client, MESOMAX 2 may refuse the stay. In this case, no refund will be made.
Article 16 - assignment of the contract by the client: The buyer may transfer his contract to an assignee who fulfills the same conditions as him to carry out the stay. In this case, the buyer is obliged to inform MESOMAX 2 of his decision by registered letter with acknowledgment of receipt no later than 7 days before the beginning of the stay.
The assignment of contract must be done at cost price. The transferor and the assignee are jointly and severally liable towards the seller, the payment of the balance of the price as well as any additional costs occasioned by this transfer.
Article 17 - Insurance: The customer is responsible for all damages arising from his act.It is required to be insured by a resort type insurance contract for these various risks.
Article 18 - inventory: An inventory is available to the tenant. It is deemed complete upon the arrival of the tenant. In case of lack or disorder, the tenant will report it from the first day to MESOMAX 2. This inventory is the only reference in case of litigation concerning the inventory. The tenant is obliged to enjoy the rented property as a good father.
The state of cleanliness of the cottage at the arrival of the tenant must be noted in the inventory. The cleaning of the premises is the responsibility of the holidaymaker during the rental period. The description of the "Cleaning package" was given to the tenant at the same time as the contract. The amount of any additional cleaning costs is established on the basis of calculation mentioned in the fact sheet.
Article 19 - Security deposit: Upon arrival, a security deposit of € 1,000 is required.
After the contradictory establishment of the inventory of the places of exit, this deposit is returned, deduction made of the cost of restoration of the places if degradations were noted.
In case of early departure (prior to the hours mentioned on the descriptive sheet) preventing the establishment of the inventory of fixtures the same day of the departure of the tenant, the security deposit is returned within a period not exceeding
not a week.
Article 20: Payment of additional services: At the end of the stay, the customer must pay to the owner, charges not included in the price. The charges included in the price are: water, electricity.
Their amount is established on the basis of calculation mentioned in the descriptive card and a proof is given by the
owner.
Article 21 - disputes: Any claim relating to the inventory of fixtures and the state of the description during a rental must be submitted within one day from the date of entry into the premises.
Any other complaint must be sent as soon as possible, by letter.
